Submission and listing terms & conditions

1. General

The EcoBusinessLinks (hereafter referred to as "EBL") environmental directory provides listings to environmental websites belonging to businesses, non-profits or individuals (hereafter referred to as the "Customer"). EBL is located at www.ecobusinesslinks.com

2. Agreement

The EBL directory is a service provided to the Customer which is ruled by the terms and conditions of this agreement. By accessing the payment form you accept the terms of this agreement and accept to be bound by it, you certify that you provide correct and true information as prompted by the submission and payment forms and you have completed the age of 18 years.

3. Listing service, submissions and acceptance principles

EBL only includes websites of Customers which promote, sell, display or rent products and/or services with a minimum ecological standard. By ecological is meant the impact of any product or service on the planet Earth and its surroundings. EBL reserves the sole right to determine whether or not a Customer's website complies with this standard. EBL reserves all rights to determine whether or not to include any Customer's website or websites. It also reserves the right to remove any website at any moment without notice in case the Customer's activities, services or products would not comply anymore with the standard. EBL reserves also the right to change at any moment and without notice it's standard and to remove or add any website. In case a website is being removed, EBL will notify the Customer with the reason(s) for removing the website from the directory. Websites which in any case will not be included in the directory are websites that sell, give or promote arms, violence, pornography, gambling or any illegal activity or product or links to sites with such content. Websites may be in foreign languages, but to be included in the directory the website owner will have to agree that this will be clearly stated with the listing of that website in the directory. EBL reserves the right to exclude any website that is not in English. EBL editors should at least be able to understand the content of the website. Languages currently understood are: English, Spanish, French, Dutch, German. Websites that are in other languages should contact the editor before applying.
Factors that may influence on the decision to include any website are: environmental considerations, content, overall design and functionality of the website, absence of unrelated pop-up advertisements for third-parties, broken links, use of spamming whether on the website or by email, etc... . The need to register or to provide an email address to get access to the Customer's website may also influence inclusion in the directory.
EBL also reserves the right to determine in which category or categories a website will be displayed, and may change the content of that directory page at any time or move the website to another category or subcategory, and change the descriptive text or title without notice. EBL reserves also the right to choose the positioning of the links and their description on any page and these can be changed without notice and for any reason as is deemed appropriate by EBL.
When a Customer wishes to submit a website to be listed in the EBL directory, sites submitted through Standard application will be reviewed after the relevant fee has been paid through its secure payment partner. EBL agrees then to review the submitted website within the time period as stated at the moment of the application. The time period will start at the moment the application form has been received on EBL's mail server and will exclude holidays, weekends and any delays caused by faulty or dishonest registration or server problems. Submitting and paying the application is no guarantee for inclusion in the directory, the payment of the fee only guarantees that your website will be reviewed within the stated time frame according to principles as mentioned earlier in this text. The Customer will be notified by email whether the website has been accepted or not.
You may occasionally receive an email from EcoBusinessLinks about new services or special advertising deals, but never more than once per month. You will be able to request to be removed from the mailing list.

4. Payment of the application fee (only for paid listings)

The relevant fee will be due for each website submitted by the Customer through Standard Listing or Logo Listing. Payments must be done by submitting a valid credit card of which the representative submitting the website has to be the rightful holder at the moment of the application. When the representative goes through the payment form and clicks on the "Click Once to Pay $xx.00" button, he agrees that the submitted credit card will be charged immediately with US$xx.00. Having agreed to the terms and conditions stated in this agreement by accessing to the payment process, any application fee paid and charged to the credit card will not be eligible for a refund, whether or not the website for which the application was made has been accepted for inclusion in the directory and whether or not the website was already included in the directory before the review of the submitted website had started.

5. Other terms

a) This agreement supersedes any previous agreement, either oral or written, between the parties with respect to listings and submissions of websites at EBL.

b) Any information supplied by a Customer in regard with the submission procedure is for internal use only. It will never by given, lent or sold to any outside parties except if necessary in those cases of legal matters in relation to the EBL directory. EBL reserves the right to use Customer's information for internal marketing purposes including advertisement offers, however the Customer will never receive more than once per month such offers.

c) Visitor numbers may go up or down, EBL does not give any guarantee of the amount of visitor numbers at EBL or the amount of visitors that will visit any Customer's website resulting from a visit to EBL. Unique visitor numbers stated on any page at EBL are truthful at the moment of publishing them and to the knowledge of EBL. Visitor numbers can never be a reason for refunding of any application fee.

d) Communication between parties will happen via email and to the email provided by the Customer respectively, or by written mail.

e) EBL directory is provided without any warranty of any kind that the directory will be functioning 100% without any interruptions or without any error. Neither EBL or any person working with or for EBL shall be liable under any circumstance for losses of any kind to a Customer due to the use of the directory, including sales, customers, profits, goodwill, data and any other kind of damage even if due to the removal of a website from the directory.

 f) You agree to indemnify and hold EBL harmless for any damages or costs incurred resulting from your violation of any law, regardless of their nature.

g) Any legal action that may arise from the use of the services of and publications by EBL will be handled entirely and solely by the appropriate courts of Santa Cruz de Tenerife, Spain.
